On May 10th, 2020, Gilbert Fuentez was arrested in Odessa for Reckless Driving while also under suspicion of being under the influence of cocaine. The detective notes that “Upon speaking with FUENTEZ, FUENTEZ was also observed to have dilated pupils and dry mouth, all consistent with the use of narcotics to wit: cocaine” (page 4, last line).

Detectives notes indicate officers observed at least 7 different traffic violations, consistent with someone under the influence of narcotics while operating a vehicle, before he was stopped. Once stopped, officers made trained observations of him being under the influence of cocaine and he was subsequently arrested for everything.
K-9 units were deployed on scene and the dogs indicated cocaine residue in Mr. Fuentez’ rental car.
Additionally, a search warrant was conducted on his hotel room and the dogs indicated the presence of cocaine residue found in the hotel room.
Reckless Driving and DUI are considered to be the same charge under law. He is facing a Class B Misdemeanor, which carries a sentence of up to 6 months in jail and a $2,000 fine.
Below are the detective notes pertaining to the arrest itself. Detective notes regarding the investigation, both before and after his arrest, will not be released to the public until after his trial and possible sentencing.
Some of the details in the arrest notes have been redacted, so as not to compromise a law enforcement investigation.

This criminal charge is pending, and all suspects are presumed innocent until proven guilty.
