Below is Everman ISD’s official response and dismissal letter to the co-worker on 3-19-2019. It is shocking and disgusting at how Everman ISD blames the co-worker for seemingly making herself out to be a victim. Everman ISD blames the co-worker for creating a situation whereby this kind of solicitation and actions by John Tinker are appropriate, welcome and wanted, which is absolutely not true in any capacity.
Had the co-worker been at fault in this situation, the co-worker would have also been placed on administrative leave, censured, disciplined or otherwise found herself in trouble and none of that happened. She was merely admonished in this complaint dismissal as a personal attack on her character for filing this Title VII DIA complaint in the first place.
It is no wonder that other victims or witnesses do not come forward to report these situations. Potential victims or witnesses may find themselves being blamed, harassed, retaliated against or disciplined somehow. It is because of this that the culture of sexual predation and unethical behavior is allowed to exist, be engaged in and covered up in Everman ISD throughout the years and predators are emboldened because they know victim shaming and blaming helps to hide their actions; especially if a victim or witness fears for their job at Everman ISD.
It was horrifying for the co-worker to read this dismissal letter, as it is filled with slander and outright lies. Within minutes of being contacted by text the morning of 2-16-2019, John Tinker went from innocuous small talk to outright propositioning the co-worker with unsolicited sexual advances that are unambiguous and crystal clear. The co-worker did not signal to John Tinker this was acceptable, nor did the co-worker solicit John Tinker to send these messages with this sexual content, proposition her, nor did she do anything that would prompt John Tinker to voluntarily reveal, within just a few text messages, the revelations he began sharing with her and continued to shared with her throughout the day.
Logically, if John Tinker was free and clear, and all these other staff were free and clear, of any substantial wrong-doing, why did Everman ISD decide to place him on administrative leave anyway and accept his resignation to leave the district? Everyone was already aware for years about the female staff member, that he sent a picture of, that they had been in a relationship years prior, even while he was married, and this was not new information. This relationship had long been over for years. So, this was NOT the smoking gun that caused Everman ISD to severe the employment relationship with John Tinker and get rid of him. Nor is it enough that Texas Education Agency has seen fit to “red flag” his certification. Everman ISD FOUND INFORMATION THAT WAS HIGHLY DAMAGING and is trying hard to cover it up.
This is a beloved coach, who is “golden” after 23 years of being in the district, and a single photo seems to be all that Everman ISD is willing to admit to what they found in this investigation. Due to privacy and employment laws, Everman ISD has every legal protection to bury any information and documentation they uncovered in their investigation and the public will never know about it. This Texas Education Agency investigation is the only hope that potential victims and witnesses, and the general voting, taxpaying community, and students, parents and staff will ever have in uncovering the real truth of the matter.
Every person in this community, no matter what role they have, should be outraged and demand answers from Everman ISD. They should not allow this type of unethical behavior to exist in Everman ISD, from the highest administrators, to the school board, down to every single staff member and potential student victim or witness.
